Rental Terms
All vehicle rentals are governed by a comprehensive Rental Agreement, which you will receive upon booking confirmation or when collecting your vehicle. This agreement outlines the specific terms, conditions, insurance coverage, fees, and your responsibilities associated with the rental. In case of any discrepancies between these Terms and the Rental Agreement, the Rental Agreement prevails.
Eligibility Criteria
Renting a vehicle requires:
- To rent a vehicle from Car Hire in Hamilton, drivers must be at least 21 years old; specific vehicle types may have different age requirements, with extra fees for those under 25. A valid full driving license for the appropriate vehicle category is necessary, held for the duration specified in the Rental Agreement. Renters must also present valid identification and proof of current address, along with payment information and a security deposit. Additional criteria outlined in the Rental Agreement must be met as well.
Booking and Payment Process
- Reservations can be made online, via phone, or directly at our Hamilton office. A deposit may be necessary to confirm your booking. The total payment, along with a security deposit, is generally required upon vehicle pickup. All pricing is listed in British Pounds (£) and includes VAT where applicable. We accept major credit and debit cards, with secure processing through trusted payment providers.
Vehicle Pickup and Drop-off
- Upon collecting your vehicle, a thorough inspection is required to identify any pre-existing damage; please report any findings right away. A vehicle condition report will be completed and signed at this time. The vehicle should be returned in the same condition as when it was picked up, with allowances made for standard wear and tear. Any new damage will be evaluated and charged to you. Ensure the vehicle is returned with the same fuel level as received; refueling fees will apply for any discrepancies. Late returns may result in extra charges, so please notify us if you expect to return the vehicle later than agreed. You will be responsible for any parking fines, traffic violations, or other charges incurred during your rental, along with a processing fee.
Insurance and Liability Overview
- All rentals come with basic third-party insurance included. You can find comprehensive coverage information and excess amounts in the Rental Agreement. Additional insurance options may be offered to lower your financial liability, so reviewing these options is advisable. You remain liable for damage or loss up to the excess amount unless you opt for extra coverage. Any damage resulting from negligence or misuse falls under your responsibility, regardless of insurance.
6. Modifications and Cancellations
Cancellation and amendment policies differ based on the type of booking and the notice provided. For precise information, please consult your booking confirmation or Rental Agreement. Be aware that late cancellations or no-shows may incur additional charges.
7. Restricted Activities
Prohibited Uses of Rental Vehicle
- The vehicle may not be used for any unlawful activities or purposes. This includes racing, rallying, off-roading, or any other dangerous driving. Transporting hazardous materials is prohibited. Sub-letting or permitting unauthorized drivers is not allowed. Driving under the influence of drugs or alcohol is strictly forbidden. Additionally, the vehicle should not be used in ways it was not intended for, nor should passenger or weight limits be exceeded. Driving outside of the designated geographical areas requires prior approval.
Breach of these terms may lead to rental termination and extra fees.
Liability Limitations
To the fullest extent allowed by English and Welsh law, Car Hire Hamilton is not responsible for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business, resulting from your use of our services. Our total liability for any claims is capped at the amount you paid for the rental in the previous year. This limitation does not apply to liability for death or personal injury resulting from negligence or for fraudulent activity.

These Terms are governed by the laws of England and Wales. Disputes will fall under the exclusive jurisdiction of the courts in this region.
